By creating an account, licensing our software tools (including Switcher, VoiceX, Megaform, and Number Revealer), entering into a custom development contract, or browsing Workerz.org, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these Terms, you must not access or use our services.
2. Eligibility & Account Responsibility
- Age Requirement: You must be at least 18 years old or the legal age of majority in your jurisdiction to enter into this legally binding agreement.
- Account Security: You are responsible for maintaining the confidentiality of your login credentials and license keys. You agree to notify us immediately at support@workerz.org if you suspect unauthorized use of your account.
- Account Termination: We reserve the right to suspend or terminate accounts that violate our security policies or engage in unauthorized distribution of licensed software.
3. Nature of Services & Disclaimers
Workerz.org is a specialized technology studio providing proprietary software licenses and custom software engineering (including inventory systems, ERPs, automotive workshop management, SaaS platforms, and outbound lead generation automation).
⚖️ Telemarketing & Scraping Compliance Disclaimer
When utilizing Workerz tools (such as VoiceX telephony or data scrapers), you are solely responsible for ensuring that your lead extraction and calling practices comply fully with all applicable local, national, and international laws, including the TCPA (Telephone Consumer Protection Act), TSR (Telemarketing Sales Rule), CAN-SPAM Act, and GDPR.
4. Prohibited Conduct
You agree not to engage in any of the following prohibited actions:
- Reverse engineering, decompiling, or attempting to extract the source code of our compiled binary desktop or mobile applications without explicit written consent.
- Using our tools to transmit unlawful, defamatory, harassing, or fraudulent communications.
- Attempting to probe, scan, or breach the vulnerability of Workerz.org servers, APIs, or proxy routing nodes.
- Reselling or sub-licensing Workerz software licenses without an authorized agency partner agreement.
5. Payments, Fees & Invoicing
Fees for software subscriptions, license seats, and custom engineering projects are billed in advance in accordance with the pricing schedule provided on our website or detailed in signed project scopes.
- Taxes: All quoted prices are exclusive of applicable sales tax, VAT, or withholding taxes, which remain the responsibility of the client.
- Late Payments: For custom engineering milestones, work on subsequent deliverables may be paused if milestone payments remain outstanding past due dates.
6. Intellectual Property & Ownership
- Workerz Proprietary Tools: All rights, title, and interest in our proprietary core software (including Switcher, VoiceX, Megaform, and the Workerz brand/logos) remain exclusively with Workerz.org.
- Custom Development IP Handover: For bespoke client software projects, 100% of the custom source code, schemas, and assets built specifically for the client are fully transferred to the client upon receipt of full payment.
7. Limitation of Liability & Warranty Disclaimer
EXCEPT WHERE EXPRESSLY PROVIDED IN A SIGNED SLA, OUR SOFTWARE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORKERZ.ORG DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED.
IN NO EVENT SHALL WORKERZ.ORG, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA LOSS, OR TELEPHONY DOWNTIME) ARISING OUT OF YOUR USE OF OUR SERVICES.
8. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved through good-faith negotiation, and if unresolved, submitted to binding commercial arbitration in Islamabad, Pakistan, or an internationally recognized arbitration forum agreed upon by both parties.
